Terms & Conditions of service
The terms of service for WebsiteOK Kanary, compliant with Spanish and European law.

1. Information about the service provider
In accordance with art. 10 of Spanish law LSSI-CE 34/2002, we inform you:

2. Scope of services
WebsiteOK Kanary provides services in the following areas:
• Design and development of websites using Next.js and React
• Building online booking systems for holiday apartments
• Integration with Booking.com, Airbnb and Vrbo (channel manager)
• Deployment and configuration of CRM/ERP systems (Dolibarr)
• Automation of marketing, guest service and invoicing (IGIC)
• International SEO optimisation
• Hosting, maintenance and technical support for websites
Services are provided to both individual clients and businesses (B2B) in Poland, Spain, Ireland and other countries of the European Union.
3. Formation of the contract
The contract is formed after:
1. Submitting an enquiry via the contact form, email or WhatsApp
2. Holding a consultation (usually a video call)
3. Sending a quote and the client accepting the terms
4. Payment of a deposit of 50% of the project value
The scope of work, delivery timeline and payment terms are agreed individually in writing on each occasion (a contract or a confirming email).
4. Prices and payments
The prices shown on the website are net prices expressed in euros (EUR).
Invoicing:
• Clients in the Canary Islands: invoice with 7% IGIC (Impuesto General Indirecto Canario)
• Clients in the European Union (companies with an EU VAT number): invoice without VAT (reverse charge — art. 196 of Directive 2006/112/EC)
• Clients outside the EU: invoice without VAT
• Individual clients in the EU: invoice with the applicable tax according to place of residence
Payments: bank transfer (Spain/EU), Stripe or Wise. Standard schedule: 50% deposit on order, 50% on delivery. For packages with a monthly fee — the fee is charged on the first day of each month.
A payment delay of more than 30 days may result in the service (hosting, support) being suspended until the arrears are settled.
5. Delivery timeline
Standard delivery timelines from the moment the deposit is paid and the materials are supplied (photos, descriptions, company details):
• Start package: 3-4 weeks
• Standard package: 4-5 weeks
• Pro package: 5-7 weeks
The timeline may be extended for reasons beyond the service provider's control (missing materials from the client, additional changes to the scope of work, availability of external APIs). In such cases the client is informed without delay.
6. Copyright and ownership
Upon receiving full payment, the client receives:
• Full rights to the website's source code
• Access to the admin panel
• Login credentials for all accounts (hosting, domain, integrations)
• The ability to move the site to another host without restriction
The service provider retains the right to feature the project in its portfolio (the Our Work section on the WebsiteOK Kanary website) with a link to the client's site — unless the client expressly forbids it.
Open-source libraries (Next.js, React, Tailwind, etc.) are subject to their own licences (MIT, Apache 2.0) preserved in the source code.
7. Hosting and the monthly fee
The monthly fee (€49 — €149 depending on the package) covers:
• Website hosting on Vercel / AWS servers
• Domain (first year free)
• SSL certificate (HTTPS)
• Automatic backups (daily)
• Security updates
• 24/7 uptime monitoring
• Technical support (up to 1h per month in the Start package, more in the higher packages)
• Minor content changes
The fee is charged monthly in advance. The client may cancel at any time with one month's notice — the website then remains the client's property, but loses WebsiteOK Kanary support and hosting.
8. Liability and limitations
The service provider undertakes to perform the services with due care, in accordance with current technical knowledge and design best practice.
The service provider is NOT liable for:
• Failures of external services (Vercel, AWS, Stripe, Booking, Airbnb, domain providers)
• Financial losses resulting from incorrect use of the system by the client or their staff
• Copyright infringement by content supplied by the client (photos, text)
• Content generated by users of the client's website (reviews, comments)
• Data loss caused by force majeure
• The client's business decisions made on the basis of data from the system
The service provider's maximum financial liability is limited to the amount of fees paid by the client over the last 12 months.
9. Right of withdrawal (consumers)
A client who is a consumer (a natural person not conducting a business) has the right to withdraw from the contract within 14 days of its formation, in accordance with Spanish law Real Decreto Legislativo 1/2007.
Exception: the right of withdrawal does not apply if the client has expressly requested that work begin before the end of the withdrawal period and work has already started. In that case the client bears a cost proportionate to the work carried out.
B2B clients (companies, autónomos) — no right of withdrawal. The terms of the contract apply.
10. Complaints

A complaint should include: the client's details, the invoice or order number, a description of the problem and the expected resolution.
The service provider will consider the complaint within 14 working days.
In the event of a dispute, a consumer may use the European Commission's ODR platform: https://ec.europa.eu/consumers/odr
11. Personal data (GDPR)
The controller of clients' personal data is Krzysztof Olejnik (NIF: ESZ3912795V), based at the address above.
Detailed information about the processing of personal data can be found in the Privacy Policy available on the website.
Clients' data is processed in accordance with:
• The GDPR (EU 2016/679)
• Spanish law LOPDGDD 3/2018 (Ley Orgánica de Protección de Datos)
• Law LSSI-CE 34/2002
At any time the client has the right to access, rectify, erase, restrict processing of, port and object to the processing of their data. Complaints may be submitted to the Agencia Española de Protección de Datos (www.aepd.es).
12. Governing law and jurisdiction
In matters not governed by these terms, the provisions of Spanish law apply, in particular:
• Código Civil (the Spanish Civil Code)
• Ley 34/2002 de Servicios de la Sociedad de la Información (LSSI-CE)
• Ley General para la Defensa de Consumidores y Usuarios (RDL 1/2007)
• Reglamento (UE) 2016/679 (GDPR)
Disputes arising from the contract will be settled by the courts with jurisdiction over the service provider's registered office — the Juzgados de Arona, Santa Cruz de Tenerife, Spain. Consumers retain the right to bring a case before the court with jurisdiction over their place of residence in accordance with EU law.
13. Final provisions
These terms take effect from the date of their publication. The service provider reserves the right to make changes — the currently applicable version is always available at websiteok.es/regulamin.
In the event of changes affecting the services provided, existing clients will be informed 30 days in advance by email.
If any provision of these terms is found to be invalid, the remaining provisions retain their force.
